Border Czar Tom Homan embarrassed a reporter who tried to press him with a gotcha question regarding the use of the ‘Alien Enemies Act’ of 1798 to deport criminal migrants.

A reporter asked, “What do you say to those who claim you are using a 200-year-old law to circumvent due process?”

An old law?” Homan replied. “It’s not as old as the Constitution and we still pay attention to that don’t we?”

The reporter continued to pepper him with questions to try to salvage the interaction, but Homan walked away.

The Gateway Pundit reported that President Trump activated the ‘Alien Enemies Act’ of 1798 to deport criminal migrants.

“Those subject to the Alien Enemies Act would not be allowed to have a court hearing or an asylum interview since they would be processed under an emergency, wartime authority — not immigration law. Instead, they would be eligible to be detained and deported, with little to no due process, under Title 50, the section of the U.S. code housing America’s war and defense laws.”

On Saturday, a radical federal judge, Chief Judge James E. Boasberg, an Obama-appointed leftist, granted a temporary restraining order to stop the Trump administration from deporting thousands of Venezuelan nationals under the Alien Enemies Act—an action well within the executive’s constitutional authority.

Their lawsuit, J.G.G. v. Trump, seeks to upend Trump’s lawful enforcement of immigration laws, arguing that invoking the Alien Enemies Act—a wartime measure historically used to remove hostile foreign nationals—is somehow “unprecedented” and “unlawful” during peacetime.
