Former Rep. Brad Wenstrup wrote an op-ed in Townhall entitled: “Europe Quietly Plans to Freeload Off American Innovation.”

In it, he wrote, “The EU is quietly considering changes that threaten to worsen current challenges.

Proposed reforms would weaken intellectual property rights, including expanding the Bolar exemption to pharmaceutical patent rights, while simultaneously considering rolling back key regulatory data protections.

These changes would undermine international obligations to respect patents and enable European, Chinese, and Indian companies to prepare and seek to commercialize generic versions of medicines while American patents remain in effect.

Such policies force American companies to bear the risks and costs of innovation, with American taxpayers ultimately subsidizing much of the world’s pharmaceutical research through higher drug prices.

Meanwhile, Europe and other nations benefit from these innovations without paying their fair share, perpetuating a pattern of ‘freeloading’ that President Trump has repeatedly criticized.”

Since it’s published, there has been an uproar.

Alex Bruesewitz, adviser to President Trump, wrote: “This is pretty shocking given that Europe wants us to fund all of their national defense. They are trying to push through a regulatory change that would allow them to take advantage of our patented innovations. That’s unacceptable.”

“The US has a $250 billion trade deficit with the European Union.

The EU has been taking advantage of the goodwill of the United States since the end of WW2.

A huge part of that is in pharmaceutical patents and IP rights.

Europe gets vastly cheaper drug prices, with Americans paying 3x more for name-brand drugs that are still under patent protection.

The EU just allows their companies to make cheap generics, forcing Americans to carry the R&D costs and pay for it all.

Once again, the socialists in the EU expect the USA to pay for everything while they get a free ride. Using the hammer of tariffs, President Trump is forcing changes in US-EU trade talks.”

“Why is Europe constantly undermining America?

We basically defend and protect them at a HUGE cost to American taxpayers Do we get thanked? No, instead we get constantly undermined.

Why does the European Union have a 250 billion trade deficit with the US (due mostly to protectionist policies and tariffs)? When it comes to patents, predominantly intellectual property and pharmaceutical patents, the EU continues to take advantage of America.

So does America need to launch a Section 301 investigation to get to the bottom of this and what these socialist bureaucrats are doing in Brussels?”
