A lawsuit against the Royal Caribbean cruise line alleges that a passenger who died last December was served 33 drinks at the bar before security detained him for unruly behavior and killed him. 

Michael Virgil, 35, had reportedly become belligerent after being served dozens of drinks and could not find his room when he attacked and threatened to kill several crew members.

The lawsuit claims that crew members tackled Virgil before injecting him with the sedative Haloperidol and using pepper spray to stop him.

Virgil died from “significant hypoxia and impaired ventilation, respiratory failure, cardiovascular instability and ultimately cardiopulmonary arrest, leading to his death which has been ruled a homicide,” it argues.

Per the New York Post:

Michael Virgil, a 35-year-old father from California, was served 33 drinks at one of the ship’s bars on the day he died in December 2024, according to a wrongful death lawsuit filed by his fiancée.

Virgil, who was detained by cruise ship security during a drunken rage and died in custody, had a blood alcohol level of 0.182 to 0.186 percent — or more than twice the legal driving limit, according to an autopsy report obtained by the Daily Mail.

His fiancee, Connie Aguilar, has alleged they injected him with a sedative after the rampage, which killed him.

Aguilar, who was traveling with Virgil and their 7-year-old autistic son, then pleaded with officials to return to port in Long Beach after the traumatizing ordeal — but the cruise line refused, her lawyer said.

The family’s attorney, Kevin Haynes, reportedly said the cruise staff would not take the family back and instead “put Michael in a refrigerator and continued the cruise for multiple days.”

Virgil’s blood alcohol content was below .20, according to the autopsy report, which was “not lethal on its own,” officials said.

Video from the cruise shows the passenger attempting to break down a door by kicking it with steel-toed boots and slamming his head on the door before security could detain him.
