Former special counsel Jack Smith will sit for testimony before the House Judiciary Committee this morning as House Judiciary Republicans probe his efforts to interfere with President Trump’s 2024 election.
In June 2023, Smith indicted Trump on 37 federal counts in Miami for lawfully storing presidential records at his Mar-a-Lago estate, which was protected by Secret Service agents.
In a separate case in Washington DC, Jack Smith indicted Trump on four counts: Conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights.
Smith will reportedly defend his investigation and continue the lie that Trump committed a crime by saying the 2020 election was stolen.
Former special counsel Jack Smith will stand by his decision to bring charges against President Trump and “false” narratives around that decision during his public testimony before the House Judiciary Committee Thursday, according to multiplereports.
“Our investigation developed proof beyond a reasonable doubt that President Trump engaged in criminal activity,” Smith is expected to say Thursday in his opening statement, according to The Associated Press. “If asked whether to prosecute a former president based on the same facts today, I would do so regardless of whether that president was a Republican or a Democrat.”
“No one should be above the law in our country, and the law required that [Trump] be held to account. So that is what I did,” Smith will say, per the AP.

The former prosecutor previously testified for over seven hours in front of the committee on Dec. 17. Jordan’s team released a 255-page transcript of Smith’s deposition on New Year’s Eve.
President Trump recently called Jack Smith out during a press conference on Tuesday. “Deranged Jack ‘Sick’ Smith,” he said, is “a sick son of a bitch.” He added, “He’s a sick guy.”
